It asks: "What justifies the authority of states over particular populations and territories, and what should happen when this authority is challenged in the present day?" (1). Starting from this fundamental question, Burke Hendrix develops an argument for the moral right of North American indigenous groups to pursue independence under conditions of democratic deliberation, yet interestingly he finds most support for this right not in standard appeals to land ownership or historical justice, but in a natural duty account of legitimate rule.
